5. Use of the Service

5.1 Scan Data Ownership

Scan results and monitoring reports generated for your websites belong to you. You may use them for your own business review, share them with your team, or export them via the provided CSV export feature.

5.2 License Restrictions

5.3 No Legal Advice & Scope Disclaimer

IMPORTANT: PolicyGen is NOT a law firm and does NOT provide legal advice. Scan findings are automated, informational assessments of publicly visible website signals.

PolicyGen does not certify regulatory compliance, determine whether any law or regulation applies to your business, or guarantee that your website satisfies any legal requirement. Findings may be incomplete, delayed, or incorrect due to the nature of automated surface-level scanning.

You are responsible for reviewing your website practices for your specific situation. For important legal questions, consult a qualified attorney licensed in your jurisdiction.

5a. Acceptable Use and Prohibited Conduct

You must use PolicyGen in a lawful, respectful manner. Acceptable use means using the Service to scan and monitor websites you own or have permission to scan, reviewing scan reports for your own compliance work, and sharing results within your team. Prohibited content and actions include:

Violations of this acceptable use policy may result in immediate account suspension or termination without notice.

6. Prohibited Uses

You may NOT use PolicyGen to:

7. Intellectual Property

7.1 Our Rights

PolicyGen and all associated trademarks, service marks, and logos are owned by us. Our software, design, and content are protected by copyright and other laws.

7.2 Your Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use PolicyGen for its intended purpose.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

9. Indemnification

You agree to indemnify and hold harmless PolicyGen from any claims, damages, or expenses arising from:

10. Privacy

Your use of PolicyGen is also governed by our Privacy Policy, which describes how we collect and use your information.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance.

12. Termination

We may terminate or suspend your access immediately, without notice, for any breach of these Terms. Upon termination:

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the applicable courts of competent jurisdiction.

13a. Complaint and Appeals Process

If you have a complaint about the Service, a scan result, a billing issue, or any other concern, we ask that you first contact us directly. We take all complaints seriously and aim to resolve them promptly.

How to submit a complaint

Appealing a scan result

If you believe a Trust Signal Score or specific finding is inaccurate or based on incorrect data, you may appeal by emailing [email protected] with "Score Appeal" in the subject. Include the URL scanned, the finding in question, and why you believe it is incorrect. A team member will review and respond within 14 business days.

Reporting abuse

To report abuse of the Service, fraudulent use, or a policy violation by another user, email [email protected] with "Report Abuse" in the subject. We will investigate and take appropriate action including account suspension or termination if warranted.

13b. How Recommendations and Rankings Work

PolicyGen produces Trust Signal Scores using an automated algorithm that checks publicly visible website signals. The algorithm weighs factors including the presence of privacy policies, cookie notices, HTTPS, contact information, tracking disclosures, and regional privacy disclosure signals.

Scores and rankings on the public leaderboard reflect these automated checks at the time of the most recent scan. A higher score indicates more visible public trust signals — it does not determine legal compliance status. Rankings are sorted by score and are updated as new scans are completed.

If you believe a score or ranking is inaccurate, follow the appeals process above.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal claim, you agree to contact us to seek informal resolution. Most disputes can be resolved through our complaint process (see Section 13a above).

14.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration rather than in court, except you may assert claims in small claims court.

15. Miscellaneous

15.1 Entire Agreement

These Terms constitute the entire agreement between you and PolicyGen.

15.2 Severability

If any provision is found invalid, the remaining provisions continue in effect.

15.3 No Waiver

Our failure to enforce any right does not constitute a waiver of that right.

15.4 Assignment

You may not assign these Terms. We may assign them to any affiliate or successor.
